Membership Terms and Obligations

1. Parties

3. Rights and Obligations of the Parties

3.1. 3.2. The Member cannot give the password provided by Gasell to other persons or organizations; the right to use the said password belongs exclusively to the Member. All responsibility arising from this situation and all claims and demands that may be asserted against Gasell by third parties or authorized authorities are reserved, as well as Gasell's right to claim all compensation and other demands arising from such unauthorized use.

3.3. The Member accepts and undertakes in advance to comply with legal regulations and not to violate them when using www.shop.gasell.com website. Otherwise, all legal and criminal liabilities that may arise shall be entirely and exclusively binding on the Member.

3.4. The Member cannot use www.shop.gasell.com website in any way that disrupts public order, violates public morals, harasses and bothers others, for an unlawful purpose, or in a way that infringes on the intellectual and copyrights of others. Furthermore, the Member cannot engage in activities (spam, virus, trojan horse, etc.) and transactions that prevent or hinder others from using the services.

These opinions and thoughts have no connection or relation with Gasell. Gasell has no responsibility for damages that third parties may suffer due to the opinions and views expressed by the Member, and for damages that the Member may suffer due to the opinions and views expressed by third parties.

3.6. Gasell shall not be responsible for unauthorized reading of member data and damages that may occur to member software and data. The Member has accepted in advance not to claim compensation from Gasell for any damage they may suffer from the use of www.shop.gasell.com website.

3.7. The Member has accepted not to access or use the software and data of other internet users without permission. Otherwise, the legal and criminal liabilities arising from this belong entirely to the Member.

3.8. The Member who violates one or more of the articles listed in this membership agreement is personally liable criminally and legally for such violation and shall keep Gasell free from the legal and criminal consequences of these violations. Furthermore, in case such violation is brought to the legal domain, Gasell reserves the right to claim compensation from the Member for non-compliance with the membership agreement.

3.9. Gasell has the right to unilaterally delete the Member's membership, delete the customer's files, documents and information at any time when necessary. The Member accepts this action in advance. In this case, Gasell has no responsibility.

3.10. The software and design of www.shop.gasell.com website are the property of Gasell, and the copyright and/or other intellectual property rights related to them are protected by relevant laws, and they cannot be used, acquired or modified by the Member without permission. Other companies and their products mentioned on this website are the trademarks of their owners and are also protected under intellectual property rights.

3.11. For the improvement and development of www.gasell.com website by Gasell and/or within the framework of legal regulations, certain information may be collected such as the name and Internet Protocol (IP) address of the Internet service provider used to access the site, the date and time of access to the site, the pages accessed while on the site, and the Internet address of the website that provides direct connection to the site.

3.12. Gasell may use members' personal information in studies related to the special preferences and interests of its users to provide better service to its users, improve its products and services, and facilitate the use of the site. 3.13. The person who becomes a member of Gasell declares and accepts that within the scope of current and/or future applications, they authorize Gasell and Flexsit group companies (all companies affiliated with the Company and/or business partners) to present product and service promotions, advertisements, campaigns, advantages, surveys and other customer satisfaction applications. The Member declares and accepts that they authorize the collection of personal and shopping information and shopping and/or consumer behavior information that they have given in the past and/or will give in the future when becoming a member of Gasell and/or by other means, for the above-mentioned purposes, sharing with all companies that are subsidiaries of Gasell, use by all companies that are Gasell and Flexsit group companies, and archiving. 3.14. Gasell may disclose the Member's personal information when requested as a legal obligation or in cases where it believes in good faith that it is necessary to (a) act in accordance with legal requirements or comply with legal processes served to Gasell; (b) protect and defend the rights and property of Gasell and Flexsit website family.

3.15. Measures have been taken within available means to ensure that the Gasell website is free from viruses and similar malicious software. In addition to this, for final security to be ensured, the user must provide their own virus protection system and ensure necessary protection. In this context, by entering the Gasell Website, the Member is deemed to have accepted that they are responsible for all errors that may occur in their own software and operating systems and their direct or indirect consequences.

3.16. Gasell reserves the right to change the content of the site at any time, change or terminate any service provided to users, or delete user information and data registered on the Gasell Website.

3.17. Gasell may change, update or cancel the terms of the membership agreement at any time without any prior notice and/or warning. Every provision that is changed, updated or abolished shall take effect for all members as of the publication date.

3.18. The Parties accept and declare that all computer records belonging to Gasell will be taken as the sole and true exclusive evidence in accordance with Article 287 of the Code of Civil Procedure, and that such records constitute an evidence agreement.

3.19. Gasell, pursuant to this membership agreement, has the authority to send informational e-mails to the e-mail addresses registered with its members and informational SMS messages to their mobile phones, and by approving this membership agreement, the Member shall be deemed to have accepted the sending of informational e-mails to their e-mail address and informational SMS messages to their mobile phone. If the Member wishes to stop receiving e-mails and/or SMS, they can perform the cancellation process from the "My Account" section.

4. Termination of the Agreement

This agreement shall remain in effect until the Member cancels their membership or the membership is canceled by Gasell.

Gasell may cancel the Member's membership and unilaterally terminate the agreement if the Member violates any provision of the membership agreement.

5. Resolution of Disputes

Istanbul Courts and Execution Offices are authorized for disputes related to this agreement.

6. Entry into Force

The Member's registration for membership means that the Member has read all the articles in the membership agreement and accepts the articles in the membership agreement. This agreement was concluded and mutually entered into force at the moment the Member became a member.
