1. Parties

1.1. Gasell Office Furniture Industry and Trade Limited Company (hereinafter referred to as "Gasell"), located at İkitelli OSB Mahallesi, Masko Mobilyacılar San. Site. 8/A Blok No:19, Başakşehir / İstanbul, which operates the www.shop.gasell.com website.

1.2. Internet user who is a member of the www.shop.gasell.com website ("Member")

2. Subject of the Agreement

The subject of this Agreement is to determine the terms of use of the member's website www.shop.gasell.com owned by Flexsit.

3. Rights and Obligations of the Parties

3.1. The Member declares and undertakes that the personal and other information provided while becoming a member of the www.shop.gasell.com website is true before the law, and that he/she will compensate Gasell immediately for all damages that may be incurred due to the untruthfulness of this information.

3.2. The member cannot give the password given to him/her by Gasell to other persons or organizations, the member has the right to use the password in question. For this reason, against all the liabilities that may arise and all the claims and demands that may be put forward against Gasell by third parties or authorized bodies, Gasell reserves the right to demand any compensation and other claims arising from the unauthorized use in question.

3.3. The member accepts and undertakes to comply with the provisions of the legal legislation and not to violate them while using the www.shop.gasell.com website. Otherwise, all legal and criminal liabilities that may arise will bind the member completely and exclusively.

3.4. The member cannot use the www.shop.gasell.com website in any way that disrupts public order, is against general morality, disturbs and harasses others, for an illegal purpose, or infringes on the intellectual and copyright rights of others. In addition, the member cannot engage in any activity or process that prevents or hinders others from using the services (spam, virus, trojan horse, etc.).

3.5. The ideas and thoughts declared, written and used by the members on the www.shop.gasell.com website are completely the members' own personal opinions and are binding on the opinion owner. These opinions and thoughts have no relation or connection with Gasell . Gasell has no responsibility for the damages that third parties may suffer due to the ideas and opinions expressed by the member and for the damages that the member may suffer due to the ideas and opinions expressed by third parties.

3.6. Gasell shall not be responsible for unauthorized persons reading member data and any damages that may occur to member software and data. The member has agreed in advance not to claim compensation from Gasell for any damages that may be incurred due to the use of the www.shop.gasell.com website.

3.7. The member agrees not to access or use the software and data of other internet users without permission. Otherwise, the legal and criminal liabilities arising from this will be entirely the responsibility of the member.

3.8. The member who violates one or more of the articles listed in this membership agreement shall be personally liable for this violation in legal and criminal terms and shall hold Gasell harmless from the legal and criminal consequences of such violations. In addition; in the event that the incident is brought to the legal field due to this violation, Gasell reserves the right to claim compensation from the member for non-compliance with the membership agreement.

3.9. Gasell has the right to unilaterally delete the member's membership and delete the customer's files, documents and information at any time when necessary. The member accepts this disposition in advance. In this case, Gasell has no responsibility.

3.10. www.shop.gasell.com website software and design are owned by Gasell , copyright and/or other intellectual property rights related to them are protected by relevant laws, and they cannot be used, acquired or changed by the member without permission. Other companies and products mentioned on this website are the trademarks of their owners and are also protected within the scope of intellectual property rights.

3.11. Certain information may be collected by Gasell for the purpose of improving and developing the www.gasell.com website and/or within the framework of legal regulations, such as the name and Internet Protocol (IP) address of the Internet service provider used to access the site, the date and time the Site was accessed, the pages accessed while on the site and the Internet address of the Web site that provides direct connection to the site.

3.12. Gasell may use members' personal information in order to provide better service to its users, improve its products and services, and facilitate the use of the site in studies targeting the special preferences and interests of its users. Gasell reserves the right to keep records of the member's movements on the www.shop.gasell.com website.

3.13. The person who becomes a member of Gasell declares and accepts that he/she allows all companies that are Gasell and Flexsit group companies (Company and/or business partners) to present him/her with product and service promotions, advertisements, campaigns, advantages, surveys and other customer satisfaction applications within the scope of the current and/or future applications. The member declares and accepts that he/she allows the collection of personal and shopping information and shopping and/or consumer behavior information that he/she provided in the past and/or will provide in the future while becoming a member of Gasell and/or through other means for the above purposes, to be shared with all companies that are Gasell affiliates, to be used and archived by all companies that are Gasell and Flexsit group companies. Unless the member notifies otherwise, he/she declares and accepts that he/she allows the collection of data when his/her membership ends, to be shared with all companies that are Flexsit group companies (Company and/or business partners), to be used and archived by all companies that are Gasell and Flexsit group companies (Company and/or business partners). Unless the Member states otherwise, he/she declares and accepts that all companies that are Gasell and Flexsit group companies (Company and/or business partners) allow him/her to contact him/her using communication channels such as internet, telephone, SMS, etc. The Member declares and accepts that he/she will not claim any direct and/or indirect material and/or moral negative and/or positive damages due to the collection, sharing, use, archiving and access to the above-mentioned information and that he/she will not hold the companies that are Gasell and Flexsit group companies (Company and/or business partners) responsible. 3.14. Gasell may disclose the member's personal information when requested as a legal obligation or when it believes in good faith that it is necessary to (a) comply with legal requirements or comply with legal processes served on Gasell ; (b) protect and defend the rights and property of Gasell and the Flexsit website family.

3.15. Measures have been taken within the available means to ensure that the Gasell website is free from viruses and similar software. In addition, in order to ensure ultimate security, the user must provide his/her own virus protection system and provide the necessary protection. In this context, by entering the Gasell Website, the member is deemed to have accepted that he/she is responsible for all errors that may occur in his/her own software and operating systems and their direct or indirect consequences.

3.16. Gasell reserves the right to change the content of the site at any time, to change or terminate any service provided to users, or to delete user information and data registered on the Gasell Website.

3.17. Gasell may change, update or cancel the terms of the membership agreement at any time without any prior notice and/or warning in any form. Every changed, updated or repealed provision will be valid for all members on the date of publication.

3.18. The parties accept and declare that all computer records belonging to Gasell will be taken as the sole and exclusive evidence in accordance with HUMK article 287 and that the said records constitute an evidentiary contract.

3.19. Gasell , in accordance with this membership agreement, has the authority to send information e-mails to its members' registered e-mail addresses and information SMSs to their mobile phones. By approving this membership agreement, the member will be deemed to have accepted the sending of information e-mails to their e-mail addresses and information SMSs to their mobile phones. If the member wishes to stop receiving e-mails and/or SMSs, they can cancel via the "My Account" section.

4. Termination of the Contract

This agreement will remain in effect until the member cancels his/her membership or until his/her membership is canceled by Gasell .

If the member violates any provision of the membership agreement, Gasell may unilaterally terminate the agreement by cancelling the member's membership.

5. Status of Disputes

Istanbul Courts and Enforcement Offices have jurisdiction over disputes regarding this contract.

6. Entry into force

The member's registration for membership means that the member has read and accepted all the articles in the membership agreement. This agreement is concluded and mutually entered into force at the time the member becomes a member.
